General terms of sale

The general terms of sale are drafted in accordance with the Hamon law n ° 2014-344 dated March 17, 2014. Last modification and update of the general terms of sale: 25/01/2018.

 

PREAMBLE - DEFINITION OF TERMS

Polytopia is a micro company registered under the name of Robin Campistron registered under the number of SIRET: 834 588 691 00016, located at 14 chemin de la serinette, 83000 Toulon. In these general terms of sale, the site Polytopia.fr will be called «the seller» and the customer or prospect will be referred as «the buyer». The term «intangible product» refers to all products or items sold online on the seller’s site. These general terms of sale are called «terms».

 

ARTICLE 1 - THE SITE

Polytopia.fr is an online sales site offering intangible products. All content on the site is the sole property of Robin Campistron.

 

ARTICLE 2 - PURPOSE OF THE GENERAL CONDITIONS OF SALE

These terms apply to individuals and professionals placing orders on the seller’s website. Their purpose is to determine the rights and obligations of both parties regarding the purchase / sale of the products offered.

Placing an order on the site polytopia.fr implies for the purchaser the complete and unreserved validation of these terms.

 

ARTICLE 3 - PRICES

The seller’s website displays all its prices in euros and excluding taxes. The seller is not subject to VAT in accordance with the VAT law not applicable for micro entrepreneurs and auto entrepreneurs, Article 293 B of the CGI.

The seller’s website offers dematerialized products and does not charge any shipping costs.

The seller reserves the right to change prices at any time, however the prices of products at the time of registration of the order by the customer are those in effect.

 

ARTICLE 4 - DELIVERY CONDITIONS

The products sold on the site are immaterial, so the customer can download the files as soon as payment is made.

 

ARTICLE 5 - RIGHT OF WITHDRAWAL

In accordance with the law, dematerialized or particular products such as specific creation for the customer does not have a right of withdrawal.

 

ARTICLE 6 - TERMS OF PAYMENT

The products sold on the site polytopia.fr must be paid at the time of the order.

The payment of the order is made exclusively in euro and by PayPal account or by credit card via the PayPal payment platform.

ARTICLE 7 - ORDERS

In order to make a first order, the buyer must have an account. In case the buyer does not have one yet, he will have to create an account when placing the order.

 

ARTICLE 8 – DELIVERY DELAY

Upon validation of the order, as well as payment the products will be directly downloadable on the site, on the space provided for this purpose.

For particular products, such as a custom product order, the customer will have to wait for the estimated time for the delivery of the product.

ARTICLE 10 – SPECIAL / PERSONALIZED PRODUCTS

The seller offers his customers personalized products. To do this, the customer can contact by email or phone the seller to determine the specific need.

The seller will then send a personalized estimate by email. In order to validate the order, the buyer must send the seller the signed quote and a deposit of 40% of the order.

On the quote, the seller will specify the expected delivery date and the price of the service, in euro and duty free in accordance with the law cited in Article 3 of these Terms.

 

ARTICLE 11 – PERSONAL DATA

In accordance with the General Data Protection Regulation, personal data concerning customers are collected in order to carry out orders and customers have the right to access, rectify and oppose data by simple request. by sending a postal letter to the head office of the seller. The application must be signed and accompanied by a photocopy of the identity document of the applicant.

The seller is the sole recipient of personal data and therefore undertakes not to disclose it to third parties without prior agreement.

ARTICLE 12 – APPLICABLE LAW AND JURIDICTION

These Terms are subject to French law. The competent court in case of dispute is that of the place of residence of the defendant.
